FAQs concerning Holiday Pay and Other Labor Updates (DOLE Labor Advisory Nos. 13-2020, 13-A-2020 and 14-2020) in relation to the COVID-19 Enhanced Community Quarantine (ECQ)

1) What are the holiday pay rules for 9 April 2020 (Araw ng Kagitingan and Holy Thursday)?

Unworked (but must be present or on leave with pay on
the work day prior to the start ofthe enhanced community
quarantine on 17 March 2020
(Basic wage + COLA) x 200%
Worked (first 8 hours) (Basic wage + COLA) x 300%
Overtime work (excess of 8 hours) Hourly rate of the basic wage x 300% x
130% x number of hours worked
Worked and Rest Day [(Basic wage + COLA) x 300%] +
[30%(Basic wage x 300%)]
Overtime work during Rest Day Hourly rate of the basic wage x 300% x
130% x 130% x number of hours worked

2) What are the holiday pay rules for 10 April 2020 (Good Friday)?

Unworked (but must be present or on leave with pay on
the work day prior to the start of the enhanced community
quarantine on 17 March 2020
(Basic wage + COLA) x 100%
Worked (first 8 hours) (Basic wage + COLA) x 200%
Overtime work (excess of 8 hours) Hourly rate of the basic wage x 200% x
130% x number of hours worked
Worked and Rest Day [(Basic wage + COLA) x 200%] +
[30%(Basic wage x 200%)]

3) What are the holiday pay rules for 11 April 2020 (Special Non-Working Day)?

Unworked No work, no pay unless there is a favorable company policy/CBA
Worked (first 8 hours) (Basic wage x 130%%) + COLA
Overtime work (excess of 8 hours) Hourly rate of the basic wage x 130% x 130% x number of hours worked
Worked and Rest Day (Basic wage x 150%) + COLA
Overtime work during Rest Day Hourly rate of the basic wage x 150% x 130% x 130% x number of hours worked

4) Can a company be excused from paying holiday pay during the ECQ?

A company is allowed to DEFER payment of holiday pay on 9, 10 and 11 April 2020, as provided in Labor Advisory No. 13-2020, until such time that the COVID-19 emergency has been abated and the normal operations of the establishment is in place.

Establishments that have totally closed or ceased operation during the ECQ are EXEMPTED from the payment of the holiday pay under Labor Advisory No. 13-A-2020.

5) Will the ECQ period be included in computing the probationary period of an employee?

No, the ECQ period shall not be included in the said computation.
